1 · Introduction

Welcome to Travel With The Magic® (“we“, “our“, “us“). By visiting our website, requesting a quote, or booking travel through us, you (“traveler“, “you“) agree to be bound by these Terms & Conditions. If you do not accept every provision, please refrain from using our services.


 

2 · Definitions

  • Supplier – Any airline, cruise line, hotel, tour operator, ground‐transport provider, insurance company, or other third‑party vendor that furnishes travel products or services.
  • Travel Services – Transportation, accommodations, excursions, tickets, or other arrangements offered by a Supplier.
  • Force Majeure – Events beyond reasonable control, including but not limited to natural disasters, pandemics, terrorism, labor disputes, government actions, or mechanical failure.

 

3 · Our Role as Your Travel Agent

Travel With The Magic acts solely as an agent for the Suppliers named in your travel documents. We do not own or operate the Travel Services you purchase and therefore cannot be held liable for any Supplier’s acts, omissions, or failure to perform. Our obligations are limited to:

  • Sourcing and quoting Travel Services at your request;
  • Relaying your payments and instructions to the relevant Suppliers; and
  • Delivering Supplier documentation and communications to you. Unless a service or rate is expressly guaranteed in writing on your invoice or itinerary, availability, pricing, schedules, and personal‑effects handling remain the responsibility of the Supplier.

 

4 · Quotes, Reservations & Payments

  • Quotes are provided in U.S. dollars and reflect current availability — they are not guaranteed until secured with a required deposit.
  • A booking is confirmed only after (i) we receive your deposit and (ii) the Supplier issues a confirmation number.
  • Final balances are subject to change due to tax increases, surcharges, or exchange‑rate fluctuations outside our control.
  • We are not responsible for price or inventory changes that occur between the time of your quote request and the completion of your booking.

 

5 · Cancellations, Changes & Supplier Fees

Suppliers impose their own change and cancellation penalties. Any such fees are levied by the Supplier, not by Travel With The Magic. Typical airline and cruise penalties escalate as the departure date approaches, up to 100 % of the trip value. Airline flight delays, reroutes, or cancellations may incur out‑of‑pocket expenses (e.g., hotels, meals, ground transport) that are not reimbursable by law. We strongly urge travelers to review each Supplier’s policy before booking and to consider comprehensive travel insurance.


 

6 · Traveler Responsibilities

You agree to:

  1. Review all confirmations within 24 hours of receipt and report any discrepancies immediately.
  2. Ensure that names, dates of birth, passport details, and travel dates are correct.
  3. Obtain and carry valid passports, visas, vaccination certificates, and other entry documents for every destination and transit point.
  4. Reconfirm flight times at least 24 hours prior to departure and monitor schedule updates for any changes.
  5. Convey these Terms to all travel companions or group members. Failure to comply may result in denied boarding or other losses for which we are not responsible.

 

7 · Travel Insurance

Travel insurance is optional but highly recommended to protect against trip cancellation, Supplier default, medical emergencies, evacuation, and baggage loss. By declining insurance, you accept full financial risk for such events. Your travel specialist can provide plan options upon request.


 

8 · Health, Safety & Entry Requirements

You assume all risks associated with travel, whether foreseen or unforeseen. For the most current information:

  • U.S. Department of State Travel Advisories: travel.state.gov
  • U.S. Centers for Disease Control & Prevention: cdc.gov/travel
  • National Passport Information Center: travel.state.gov/passports
    Governments may deny entry to travelers with criminal records. Regu­lations, including COVID‑19 protocols, can change without notice — check them frequently.

 

9 · Currency

All prices, invoices, and payments are processed in U.S. dollars (USD) unless otherwise stated in writing.


 

10 · Limitation of Liability & Force Majeure

To the maximum extent permitted by law, Travel With The Magic’s liability for any claim shall not exceed the commission actually earned on your booking. We are not liable for:

  • Supplier defaults, schedule changes, or acts/omissions;
  • Illness, injury, death, property loss, or delay;
  • Force Majeure events.
    By embarking on travel you voluntarily assume all associated risks.

 

11 · Intellectual Property

All content on this site—text, images, layout, and code—is © Travel With The Magic or our licensors. Personal, non‑commercial use is permitted; any other use requires prior written consent. Unauthorized reproduction, redistribution, or imitation of the site design may violate copyright, trademark, and unfair‑competition laws.


 

12 · Privacy

We respect your privacy. Please review our separate Privacy Policy to learn how we collect, use, and protect personal information, including rights under the GDPR and CCPA.


 

13 · Accessibility

Our website is designed to be usable with common assistive technologies. If you encounter an accessibility barrier, email accessibility@travelwiththemagic.com and we will assist you.


 

14 · Governing Law & Dispute Resolution

These Terms are governed by the laws of the Commonwealth of Massachusetts. All disputes shall be resolved exclusively in the state or federal courts located in Essex County, MA, and you consent to personal jurisdiction and venue therein.


 

15 · California Seller of Travel — CST 2101882

Travel With The Magic is a registered participant in the California Seller of Travel program. Registration does not constitute state approval. We maintain a trust account as required. We are not a participant in the California Travel Consumer Restitution Corporation.  In the event of cancellation where the traveler is not at fault and has not violated Supplier terms, all sums for services not provided will be refunded promptly unless already remitted to a wholesaler or carrier that defaults.


 

16 · Updates to These Terms

We may amend these Terms at any time. Changes take effect 14 days after posting unless a later date is specified. Continued use of our services constitutes acceptance of the revised Terms.
