1 · Introduction

Welcome to Travel With The Magic® (“we“, “our“, “us“). By visiting our website, requesting a quote, or booking travel through us, you (“traveler“, “you“) agree to be bound by these Terms & Conditions. If you do not accept every provision, please refrain from using our services.


 

2 · Definitions

  • Supplier – Any airline, cruise line, hotel, tour operator, ground‐transport provider, insurance company, or other third‑party vendor that furnishes travel products or services.
  • Travel Services – Transportation, accommodations, excursions, tickets, or other arrangements offered by a Supplier.
  • Force Majeure – Events beyond reasonable control, including but not limited to natural disasters, pandemics, terrorism, labor disputes, government actions, or mechanical failure.

 

3 · Our Role as Your Travel Agent

Travel With The Magic acts solely as an agent for the Suppliers named in your travel documents. We do not own or operate the Travel Services you purchase and therefore cannot be held liable for any Supplier’s acts, omissions, or failure to perform. Our obligations are limited to:

  • Sourcing and quoting Travel Services at your request;
  • Relaying your payments and instructions to the relevant Suppliers; and
  • Delivering Supplier documentation and communications to you. Unless a service or rate is expressly guaranteed in writing on your invoice or itinerary, availability, pricing, schedules, and personal‑effects handling remain the responsibility of the Supplier.

 

4 · Quotes, Reservations & Payments

  • Quotes are provided in U.S. dollars and reflect current availability — they are not guaranteed until secured with the required deposit.
  • A booking is confirmed only after (i) we receive your deposit and (ii) the Supplier issues a confirmation number.
  • Final balances are subject to change due to tax increases, surcharges, or exchange‑rate fluctuations outside our control.
  • We are not responsible for price or inventory changes that occur between your quote request and the completion of your booking.

 

5 · Cancellations, Changes & Supplier Fees

Suppliers impose their own change and cancellation penalties. Any such fees are levied by the Supplier, not by Travel With The Magic. Typical airline and cruise penalties escalate as the departure date approaches, up to 100 % of the trip value. Airline flight delays, reroutes, or cancellations may incur out‑of‑pocket expenses (e.g., hotels, meals, ground transport) that are not reimbursable by law. We strongly urge travelers to review each Supplier’s policy before booking and to consider comprehensive travel insurance. Suppliers reserve the right to modify or cancel itineraries, flight schedules, ports of call, accommodations, attractions, entertainment offerings, dining experiences, transportation schedules, and other travel services without prior notice. Travel With The Magic is not responsible for these supplier-initiated changes but will make reasonable efforts to assist clients in working with the supplier to resolve issues.


 

6 · Traveler Responsibilities

You agree to:

  • Review all confirmations within 24 hours of receipt and report any discrepancies immediately.
  • Ensure that traveler names exactly match the government-issued identification that will be used for travel.
  • Verify that dates of birth, passport information, travel dates, and reservation details are accurate.
  • Obtain and carry valid passports, visas, REAL ID-compliant identification (when applicable), vaccination documentation, and any other documents required by airlines, cruise lines, immigration authorities, or destination governments.
  • Reconfirm flight times at least 24 hours before departure and continue monitoring your airline for schedule changes.
  • Respond promptly to requests for information, approvals, payments, and travel documentation. Travel With The Magic is not responsible for supplier penalties, increased costs, or canceled reservations resulting from delayed responses.
  • Review all travel documents before departure and immediately notify Travel With The Magic of any errors or discrepancies.
  • Convey these Terms & Conditions to all travelers included in your reservation.

Travel With The Magic verifies travel information using official supplier and government resources whenever reasonably possible. Clients acknowledge that travel requirements and supplier policies may change and are responsible for reviewing their final travel documents and confirmations prior to departure.


 

7 · Travel Insurance

Travel insurance is optional but highly recommended to protect against trip cancellation, Supplier default, medical emergencies, evacuation, and baggage loss. By declining insurance, you accept full financial risk for such events. Your travel specialist can provide plan options upon request.


 

8 · Health, Safety & Entry Requirements

You assume all risks associated with travel, whether foreseen or unforeseen. For the most current information:

  • U.S. Department of State Travel Advisories: travel.state.gov
  • U.S. Centers for Disease Control & Prevention: cdc.gov/travel
  • National Passport Information Center: travel.state.gov/passports
    Governments may deny entry to travelers with criminal records. Regu­lations, including COVID‑19 protocols, can change without notice — check them frequently.
  • Some countries and travel suppliers may require notarized consent forms, custody documentation, medical documentation, or other legal documents for minors traveling without both parents or legal guardians. It is the traveler’s responsibility to determine and obtain any required documentation.

 

9 · Currency

All prices, invoices, and payments are processed in U.S. dollars (USD) unless otherwise stated in writing.


 

10 · Limitation of Liability & Force Majeure

We are not liable for:

  • Supplier defaults, schedule changes, or acts/omissions;
  • Illness, injury, death, property loss, or delay;
  • Force Majeure events.
  • By embarking on travel, you voluntarily assume all associated risks.

 

11 · Intellectual Property

All content on this site—text, images, layout, and code—is © Travel With The Magic or our licensors. Personal, non‑commercial use is permitted; any other use requires prior written consent. Unauthorized reproduction, redistribution, or imitation of the site design may violate copyright, trademark, and unfair‑competition laws.


 

12 · Privacy

We respect your privacy. Please review our separate Privacy Policy to learn how we collect, use, and protect personal information, including rights under the GDPR and CCPA.


 

13 · Electronic Communications

Travel With The Magic communicates primarily through email and electronic platforms, including TravelJoy. By using our services, you consent to receive itineraries, invoices, confirmations, travel documents, notices, and other communications electronically.

You are responsible for maintaining a valid email address and monitoring your inbox, including spam or junk folders. Travel With The Magic is not responsible for missed communications, supplier deadlines, cancellations, or penalties resulting from emails that are filtered, blocked, or not reviewed by the traveler.

Electronic signatures and acknowledgments submitted through TravelJoy or another approved electronic platform shall have the same legal force and effect as handwritten signatures, to the fullest extent permitted by applicable law.

14 · Technology & Artificial Intelligence

Travel With The Magic utilizes technology to assist in providing travel planning services. We are not responsible for delays, interruptions, or errors resulting from failures of supplier reservation systems, airline systems, payment processors, internet service providers, cybersecurity incidents, or other third-party technology beyond our reasonable control.

We may also utilize artificial intelligence (“AI”) tools to assist with travel research, itinerary preparation, administrative tasks, marketing, and customer communications. AI is used solely as a support tool and does not replace the professional judgment or oversight of our travel advisors. Additional information regarding our use of AI is available in our Artificial Intelligence (AI) Disclosure.

15 · Changes to Travel Experiences

Travel experiences are dynamic and may change before or during your trip. Travel suppliers reserve the right to modify or cancel attractions, entertainment, dining experiences, character appearances, park hours, special events, transportation schedules, ports of call, excursions, onboard activities, amenities, operating procedures, and other components of your vacation without prior notice.

For theme park vacations, attractions may close temporarily or permanently due to maintenance, weather, capacity limitations, refurbishment, operational needs, or other circumstances. Reservation systems, virtual queues, Lightning Lane offerings, entertainment schedules, character appearances, and dining availability may also change at any time.

For cruises, ports of call, itineraries, onboard entertainment, dining venues, activities, and shipboard experiences may be modified or canceled due to weather, operational requirements, safety considerations, government regulations, or the cruise line’s decisions.

Travel With The Magic has no control over these supplier decisions and cannot guarantee the availability of any specific attraction, entertainment offering, dining reservation, excursion, event, amenity, or itinerary. We are not responsible for supplier-initiated changes but will make reasonable efforts to assist clients in understanding available alternatives when possible.

Recommendations provided by Travel With The Magic are based on information available at the time of planning. Because suppliers regularly update policies, operating procedures, attractions, pricing, and offerings, recommendations may change after they are provided.

16 · Accessibility

Our website is designed to be usable with common assistive technologies. If you encounter an accessibility barrier, email accessibility@travelwiththemagic.com and we will assist you.


17 · Payment Disputes & Chargebacks

If you have questions or concerns regarding charges associated with your reservation, you agree to contact Travel With The Magic before initiating a chargeback or payment dispute with your financial institution.

Initiating a chargeback does not relieve you of your obligations under these Terms & Conditions or the applicable Supplier’s Terms & Conditions. Fraudulent or unwarranted chargebacks may result in the cancellation of travel arrangements and additional collection efforts as permitted by law.

18 · Governing Law & Dispute Resolution

These Terms are governed by the laws of the Commonwealth of Massachusetts. All disputes shall be resolved exclusively in the state or federal courts located in Essex County, MA, and you consent to personal jurisdiction and venue therein.


 

19 · California Seller of Travel — CST 2101882

Travel With The Magic is a registered participant in the California Seller of Travel program. Registration does not constitute state approval. We maintain a trust account as required. We are not a participant in the California Travel Consumer Restitution Corporation.  In the event of cancellation where the traveler is not at fault and has not violated Supplier terms, all sums for services not provided will be refunded promptly unless already remitted to a wholesaler or carrier that defaults.


 

20 · Updates to These Terms

We may amend these Terms at any time. Changes take effect 14 days after posting unless a later date is specified. Continued use of our services constitutes acceptance of the revised Terms.
